Summary Three Adiala Jail inmates have challenged an IHC ruling before the Federal Constitutional Court, seeking medical facilities and communication rights similar to those available to Imran Khan.
ISLAMABAD (Dunya News) – Three inmates of Adiala Jail have approached the Federal Constitutional Court seeking medical facilities similar to those provided to Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan.
The prisoners have challenged an Islamabad High Court (IHC) decision before the Federal Constitutional Court, seeking an order that they be provided the same medical facilities available to the PTI founder. The development was also reported by Express News on September 8.
In their petitions, the prisoners have requested that the IHC decision be set aside and that they be allowed access to the same medical treatment and facilities available to Imran Khan. They argued that Article 25 of the Constitution requires equal treatment of citizens and maintained that the Supreme Court’s order regarding Imran Khan remains applicable.
The petitioners also referred to the Supreme Court’s August 18 order directing authorities to transfer Imran Khan to Shifa International Hospital for medical examination and treatment. They have requested that they too be allowed to receive treatment at Shifa International Hospital.
The prisoners further sought an order allowing them to communicate with relatives abroad through WhatsApp, similar to the facility sought in Imran Khan’s case.
The petitions follow an IHC ruling concerning three Adiala prisoners — Owais Altaf, Ilyas Khan and Muhammad Ismail — who had sought treatment at private hospitals and permission to communicate with relatives abroad. The IHC had ruled that treatment at a private hospital could be allowed on the recommendation of a medical board and that communication facilities remained subject to prison rules and security requirements.
The IHC had reserved its decision after hearing arguments from the prisoners’ counsel and government representatives. The petitioners had argued that prisoners were also citizens and were entitled to equal treatment under the law.
The Supreme Court had on August 18 ordered that Imran Khan be shifted to Shifa International Hospital for medical assessment and treatment until September 16, while also directing the formation of a medical board for his care.
The Federal Constitutional Court has now separately numbered the three appeals filed against the IHC decision. The first appeal has been assigned number 2050/2026, the second 2051/2026, and the third 2052/2026.
